Terms & Conditions

Please note that the following travel terms and conditions were communicated to you before your booking as part of our travel offer; thus, you fully acknowledge them with your confirmed booking and prepayment deposit. If you have not done that already, please click on the DETAILED TERMS tab below and read thoroughly the complete set of our Terms and Conditions BEFORE booking and paying for any of our travel services. Our terms and conditions may only be waived by our company’s administrator and general manager (Mr. Ioannis Sampsonidis) and only in writing. Upon acceptance of your booking, we agree to carry out our obligations to you as defined online on our Terms and Conditions webpage.

These terms & conditions are subject to and shall be construed according to Greek law.

Booking Procedure

A booking for one of our trips starts by checking availability and exchanging communication with us until all your travel needs are addressed, and all your questions are answered. Following your request, we will design, put a price on, and send you our best travel offer by email. Our non-binding offer will be valid for seven days, enough time for you to proceed to a deposit of 20%-50% of the total price (depending on the travel package terms) if you decide to. A booking is not confirmed on our end before we receive your deposit; at this point, a receipt will be issued and sent to you via email. All invoices are issued by the tour operator company “TRAVEL AND DO ESERVICES” which is a member of the Greek General Commercial Register (G.E.MI) and licensed by the Greek National Tourism Organisation and the Greek Ministry of Tourism, providing you with complete safety for your money paid. The balance is due 40 days before your arrival. Payments are accepted with a bank wire or Credit Card. If the balance is not paid at the specified time, unless previously arranged with us in writing, we reserve the right to cancel the booking according to our cancellation policy. A 5% early booking discount may apply to some of our trips (check out our “Special offers & discounts” webpage or look for the early bird icon) when full payment is completed 90 days or more before your arrival.

Contract and Governing Law

After receiving your deposit or full payment (if applicable) and issuing and sending you a confirmation invoice via email, a travel contract will exist between you and TRAVEL AND DO ESERVICES, effective from the date printed on your invoice. This contract clearly states that you have booked a tour with us, and by doing so, you have accepted our Cancellation Policy and Privacy Policy as presented on our website. Your contract with TRAVEL AND DO ESERVICES is governed by the laws of Greece, and you agree to submit to the jurisdiction of the courts of Athens, Greece, to determine any dispute on the contract.

Currencies accepted

The currency accepted is EURO (€). All other currencies must be switched to Euro for the bank wire transfer.

Included/Not Included Services

Every travel package’s final price includes all services specified in the itinerary. Unless otherwise mentioned, it does not include Visa and passport charges, international flights, travel and medical insurance, meals/services not included in the itinerary, expenses of a personal nature, and emergency costs.

Complaints

If you are dissatisfied with any aspect of your vacation plan, the matter should be raised with the tour leader as soon as possible. Matters can usually be put right on the spot. Failure to do this will adversely affect any claim at a later date. In the event of continuing dissatisfaction, the complaint should be made to us in writing within 90 days of your return. We will investigate thoroughly and report back to you as soon as possible. You can send your complaint here.

Alterations by us

We reserve the right to alter arrangements and itineraries because of operational factors or when we consider it in the best interests of our clients. Changes will be made known to clients as soon as possible. A refund may be given if these changes are considered substantial and unacceptable to you. Regarding financial alterations, we reserve the right to alter quoted prices. Should any price increase exceed 5% of the total cost, you, the client, have the right to cancel the booking, and a refund will be given to you. Less than 40 days before the date of commencement of your vacation program, no additional price charges will be made except when the booking has been made within this period. In this case, additional charges may be made up to and including the date on which the invoice is issued.

Alterations by you

Any special requirements should be notified at the time of booking. Alterations after booking are sometimes possible, but note that there may be an administration charge of 30,- for this service.

Cancellation by us

We reserve the right to cancel the trip:

a. up to 21 days before vacation’s starting date if a minimum number of participants will not be achieved or
b. anytime, for reasons that are beyond our control (force majeure).
If cancellation is due to ‘force Majeure (inclusive of war, civil or political unrest, and natural disasters), reasonable expenses we have incurred will be deductible from any refund.
Any compensation and refund are strictly limited to monies paid to us. We are not liable for any expense you have incurred as a result of your booking, and we will accept no responsibility for further compensation of any kind. We are not responsible for any loss resulting from cancellation or changes in international gateways, itineraries, or travel dates. Therefore, it is best for you to avoid airline tickets with high date-change fees.

Cancellation by you

All cancellations must be submitted in writing. If your cancellation is received up to 41 days before your vacation’s starting date, your tuition will be refunded less than 5% processing/bank fees.

On cancellations by you, the following charges will apply (in a percentage of the total cost):

– 41 days or more before vacation’s starting date:        05%

– 40 to 31 days before vacation’s starting date:            20%

– 30 to 21 days before vacation’s starting date:            30%

– 20 to 11 days before vacation’s starting date:             60%

– 10 days or less before vacation’s starting date:         100%

Unused Accommodation and Services

Our trips always include accommodation and various add-on services as specified in your confirmed itinerary. Refunds cannot be made for any of these not used for whatever reason.

Travel and medical insurance

A condition for participation in our holiday plans is that you are adequately insured and provide us with a copy of your travel insurance policy. Your insurance company must know the type of trip you are undertaking. Insurance must cover you fully against repatriation costs should you become too ill to continue the tour.

Passports and Visas

We will give general advice on passport and visa requirements, but it is your responsibility to ensure that you meet all official requirements for the trip. Most countries beyond Europe require passports to be valid at least six months after entry. Be sure that the name given to us is the same as on your passport.

Behavior

The tour leader, guide, or local ground operator who represents us has overriding authority on our trips. The instructions of the tour leader/guide must be followed at all times for the safety and well-being of individuals and the group. You agree to comply with such instructions on acceptance of our Terms and Conditions. We reserve the right to require any person to withdraw from the trip if their behavior is deemed offensive, dangerous, or incompatible with the conduct of others, and we shall be under no further liability to any such person.

Health

We will give general advice on health matters before the trip, but you are advised to consult your doctor for specific guidance. Depending on your journey, parts may be strenuous, and your responsibility is to be adequately fit. A basic first aid kit will be carried during the trip, but the tour leader/guide is not medically qualified, and any treatment will be only with your consent. Be sure that you carry any specific personal medication. You will be asked to sign a Health and Safety waiver (release of liability) before the commencement of your trip.

Risk

While every effort will be made for your comfort, it must be understood that all trips involve a degree of risk and discomfort. We accept no liability for any loss, damage, injury, expense, delay, or inconvenience. We cannot be held responsible, unless as a direct result of negligence, for any mishap to yourself or your property.

I confirm that I and all participants listed on my booking:

– have not been in close contact with people who have been diagnosed with COVID-19 30 days or less before my/our arrival to Greece.
– are not in quarantine or isolation at the time of my/our departure to Greece.
– don’t have symptoms that may indicate that I/we may be infected with COVID-19.

I/we also confirm that I and everyone listed on my booking:

– are aware of and follow the authorities’ guidelines for infection control and entry.

Due to the ongoing COVID-19-related restrictions, all travelers booking with us must sign a WAIVER before their arrival.

General Travel Terms and Conditions

According to the Greek Law on Travel and the European Directives on Providing Services in Tourism “TRAVEL AND DO ESERVICES (hereinafter referred to as the Agency) passes the following Terms and Conditions.

Reserving or participating in any travel services offered by the “Agency”, “we”, “us”) constitutes a contractual agreement between the participant (“you”) and the Agency and is an acknowledgment that you have read, understand, and agree to be bound by these Terms & Conditions (“Terms”), which include a Health & Safety and any other applicable waivers for your trip. You must be at least 18 years of age to make a reservation. In all cases, the person making the reservation represents and warrants that all participants have consented to, accepted, and agreed to be bound by these Terms.

The Agency reserves the right to update or amend these Terms at any time prior to you making a reservation. An up-to-date copy of these Terms is accessible on Agency’s website at https://travelanddo.net/business_terms_conditions/. The Terms listed online when completing a reservation are those that control.

Any payment made to The Agency shall be deemed to constitute full acceptance of these Terms, including a Health & Safety Waiver.

Additional Terms & Conditions apply to Group reservations (being a reservation with 8 or more participants). The Agency provides these Group Reservation Terms & Conditions at the time the Group reservation is made or upon request.

Contract and Governing Law

After we have received your deposit or full payment (if applicable) and we have issued and sent to you via email a confirmation invoice, a contract will exist between you and the Agency, effective from the date printed on your invoice. Your contract with the Agency is governed by the laws of Greece, and you agree to submit to the jurisdiction of the courts of Athens Greece to determine any dispute pertaining to the contract.

GENERAL PROVISIONS

The Agency, seated in Athens, at 56, Stratigou Dagli st, with VAT number: EL044848346, is registered for providing services in the tourism sector by decision of the Greek Ministry of Tourism. 

  • The most important terms of these services are:

  1. ‘travel service’ means:

  2. a) traveler transport

  3. b) accommodation that is not inseparable from the traveler’s transportation and is not intended for housing purposes

  4. c) car or motorcycle rental

  5. d) any other tourist service which is not inseparable from the travel service in the sense of sub-paragraphs a), b) or c) of this point

  6. ‘package’ means a combination of at least two different types of travel services for the purpose of the same trip or holiday

  7. ‘package travel contract’ means a contract on the package as a whole 

  8. linked travel arrangement’ means at least two different types of travel services bought for the purpose of the same trip or holiday, not constituting a package, resulting in the conclusion of separate contracts with the individual travel service providers, if the trader: a) allows the travelers a separate choice and separate payment for each travel service upon one visit to its point of sale or one contact with it or b) allows a targeted purchase of at least one additional service from another trader if the contract with the other trader is concluded no later than 24 hours after the booking confirmation of the first travel service

  9. traveler’ means any person wishing to conclude a travel contract in a package travel or trip or a travel contract in a linked travel arrangement or who is entitled to travel on the basis of a concluded travel contract in a package travel or excursion or a travel contract in a linked travel arrangement.

  10. organizer’ means a trader who combines and sells or offers for sale a package, directly or through another trader or together with another trader, or a trader who provides information on a traveler to another trader.

  11. seller’ means a trader who is not an organizer but who is selling or offering for sale packages combined by the organizer.

  12. durable medium’ means any instrument that enables the traveler or the trader to store information addressed personally to him in a way accessible for future reference for a period of time adequate for the purposes of the information and which allows the unchanged reproduction of the information stored.

  13. extraordinary circumstances’ that could not be avoided means a situation beyond the control of a party invoking such a situation and the consequences of which could not be avoided even if all reasonable measures were taken.

  14. lack of conformity’ means lack of or improper performance of the travel services included in a package.

  15. minor’ means any person under the age of 18

  16. consumer’ means any natural person who concludes a legal transaction or acts in a market outside his trade, business, craft, or professional activity.

  17. excursion’ means a combination of at least two individual services for the same travel or holiday, consisting of transportation or other tourist and hospitality services, lasts less than 24 hours and does not include accommodation.

  18. travel organizing service’ means providing a combination of at least two different types of travel services that are offered as a package or excursion. 

  • Non-disclosure of business secrets and personal data protection

The Agency shall keep any information acquired from the traveler as a business secret and shall not pass his personal data to third parties without his consent, except in cases prescribed by the law.

The Agency shall fully respect and implement the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and other related regulations, and passed the Declaration on the Protection of Personal Data of the Agency. 

The traveler provides personal information voluntarily, and it is needed in the process of realizing the required service. The Agency is committed not to providing personal data to third parties except for the purpose of realizing the requested service. Exceptions to providing data to third parties are insurance companies that will forward the personal information of the traveler if the traveler concludes a travel insurance policy. The personal data of the traveler will be kept in the Agency’s database and may be used for the purpose of marketing activities of the Agency. For all the above-mentioned, the Agency will acquire the traveler’s consent and act in accordance with its Declaration on the Protection of Personal Data. 

  • Pre-contractual information for excursions and packages 

The Agency shall provide the traveler with all pre-contractual information, which shall make an integral part of the package travel contract, whereby they shall be amended with the agreement of the contracting parties unless otherwise agreed by the contracting parties.

  • Package Travel Contract

The Agency and the traveler shall conclude a package travel contract in a written form, and the Agency shall provide a copy of the contract or confirmation about the contract to the traveler on a durable medium, specifying the full content of the agreement of the contracting parties.

  • Transfer of the package travel contract to another traveler

Suppose a traveler wishes to transfer a package travel contract to a person who fulfills all the conditions applicable to this contract. In that case, he/she is obliged to notify the Agency on a durable medium and within a reasonable time before the package starts, but no later than 7 days prior to the start of the package, and with the solidarity of the transferor and the person to whom the contract is transferred for payment of the amount of the fee and for any additional fees, duties or other costs arising from the transfer of the contract.  

Pricing & Price Guarantee

Pricing for our trips and services is subject to change at any time prior to receipt of the full deposit. The Agency reserves the right to re-invoice your reservation should an error be made in computing your vacation price. Once The Agency receives full payment for services, the price is guaranteed not to increase unless you amend your reservation (see Errors & Omissions below).

Deposit to Hold Space

At the time of reservation, a per-trip deposit is required. The deposit amount is dependent upon the trip and services booked. 

Full payment is required by the final payment date. The final payment date is dependent upon the trip and services booked. 

If you do not pay the full invoice by the final payment date, your reservation and all services on the reservation will be canceled, and your deposit will be forfeited.

Reservations made after the final payment date require full payment at the time of reservation and will include any late reservation fees.

Ways to Pay

The Agency accepts payment via Visa, MasterCard, and American Express credit cards as well as via bank wire. 

Confirmation

Your reservation is confirmed when your initial deposit payment is processed. Your invoice, when documented as payment received, is a confirmation of services on the reservation.

Accuracy of Invoice Details

You are responsible for providing and verifying full, complete, and accurate information for all participants and services at the time of reservation. Under no circumstances is The Agency liable for any errors or omissions in the information provided by you to complete the reservation. If you do not notify The Agency of any error within 5 days of making the reservation, you are solely responsible for all fees assessed due to incomplete, erroneous, or inaccurate details.

Errors & Omissions

In the event the price listed, quoted, or confirmed is incorrect due to a system error, human error, or other error, The Agency reserves the right to correct the price and reinvoice you at the correct price.

  • Modification of non-price-related terms in the package travel contract

Prior to the start of the package, the Agency may unilaterally modify the terms of the package travel contract. In such case, the traveler will be notified about the modification in a clear, understandable, and easily visible way on a durable medium, where the traveler may, within a reasonable period specified by the Agency:

  1. a) accept the proposed modification or

  2. b) terminate the contract without paying compensation for termination of the contract.

The traveler is committed to notifying the Agency about his/her decision within a reasonable time specified by the Agency. Upon expiry of that time, the contract shall be deemed terminated.

In the event of a cancellation of a package travel contract, the Agency shall, without undue delay and within 14 days of the termination of the contract, refund all payments made in favor of the traveler.

  • The right of the traveler to terminate the package travel contract and the right to cancel before the package starts

If a traveler terminates a package travel contract, the Agency will demand the traveler to pay a reasonable fee for the termination of the contract that can be justified.

The package travel contract will establish reasonable standard termination compensation fees based on the period between the termination of the contract and the start of the package and expected organizer cost savings and revenue from providing travel services to another user.

In the event of an accident that has a significant effect on the health status of the traveler, resulting in a termination of the package travel contract on the traveler’s end, the traveler is still only entitled to a refund based on the period between the termination of the contract and the start of the package.

The Agency is obliged to refund all payments made to the traveler, decreased for the appropriate compensation for the termination of the contract, without undue delay, and no later than 14 days after the termination of the package travel contract. 

  • The right of the organizer to terminate the package travel contract before the package starts

The Agency shall reserve the right to terminate the package travel contract prior to the start of the package if the Agency has been prevented in the performance of the contract by exceptional circumstances that could not have been avoided and if the Agency informs the traveler without undue delay about the termination of the contract prior to the start of the package.

The Agency also has the right to terminate the contract if the number of persons registered for the package is less than the minimum number of travelers specified in the package travel contract and if the Agency notifies the traveler about the termination of the contract within the period stipulated in the contract, but no later than:

21 days prior to the start of the package travel, if the trip lasts more than 6 days

7 days prior to the start of the package, if the trip lasts between 2 and 6 days

48 hours prior to the start of the package, if the trip lasts less than 2 days.

In case of termination of the contract for the reasons stated in this point, the Agency is obliged to fully refund all payments for the package to the traveler without any obligation to compensate the traveler, at the latest, within 14 days of the termination of the contract.

  • Correction of non-conformances in the execution of travel services included in the package travel

The traveler shall, without undue delay and taking the circumstances into account, notify the Agency of any non-conformance found during the performance of the travel service included in the package travel contract.

Suppose any of the travel services were not carried out in accordance with the package travel contract. In that case, the Agency will correct this non-compliance upon request of the traveler, unless this is not possible or if the elimination of the non-compliance would cause disproportionate costs considering the scale of non-compliance and the value of the travel service the non-compliance affects.

If the Agency fails to correct the non-compliance for the reasons referred to in paragraph 2 of this item, the traveler shall be entitled to a reduction in the price and compensation for damage.

SPECIAL PROVISIONS WITH PACKAGE TRAVELS

  1. Own package travels and package travels of other organizers

The Agency provides all kinds of travel services in the package. Trips are organized in the form of ready-to-travel packages or travel programs according to special requirements. 

The Agency, as a travel organizer, shall guarantee the implementation of the travel program according to the package described in accordance with the pre-contractual information and the contract and all its constituent parts. Except in the case of extraordinary circumstances (war, riots, strikes, terrorist actions, sanitary disorders, natural disasters, intervention by competent authorities, etc.), the Agency’s program package will be executed in full and in a contractual and descriptive manner.

The Agency also sells, as a SUBAGENT, programs of other travel organizers as intermediaries, and each package states the organizer of the travel package program as well as its general terms and conditions applicable to that package. 

A package shall be deemed to have been contracted upon signing these General Terms and upon payment of the entire amount of the package price or part of the amount with indisputable payment of the remaining amount.

By signing the contract, or by paying the whole amount of the price of the arrangement or deposit, it is considered that the user of the package ACCEPTS AND FULLY ACKNOWLEDGES these General Terms and conditions as well as the terms of the contract in question and shall be the exclusive basis for the regulation of mutual rights and obligations.  

Registrations and payments

Registrations for packages are received on a special form on the Agency’s premises, via E-Mail or Website, and payments are made as follows: 

  1. Upon registration, the traveler will pay at least 20% of the package price, and the remaining percentage of the amount is to be paid no later than 40 days before the start date of the travel service

  2. For package travels of other organizers, valid conditions to the general conditions/price list of the responsible organizer shall be used. 

  3. Package contents and price

The contents of the package, i.e., the price of the same, include everything the Agency as a travel organizer has included in the travel program. Special services are services that are not included in the price and are therefore paid extra by the traveler. These services should be requested at check-in and are charged on the package price. Optional and special services requested by the traveler during the travel period are paid to the travel manager or agent of the Agency in the currency of the country where the service is provided. 

Package prices are published in EUR. The Agency reserves the right to change the published prices in accordance with these General Terms.  

Change of program due to extraordinary circumstances

The Agency has the right to change the conditions/travel program if there are exceptional circumstances that cannot be foreseen, avoided, or eliminated.  

Health Regulations

The Agency will inform the traveler of the general information on the health formalities of Greece. The Agency will not incur any damage to the traveler’s violation of the healthcare formalities.  

  1. Cancellation of the trip by the traveler

If a traveler wishes to cancel the trip in the package he/she has to do this EXCLUSIVELY IN WRITING. The date of receipt of the written cancellation by the Agency shall constitute the basis for the calculation and collection of the costs incurred, and the traveler shall pay to the Agency from the total amount of the package price, as follows: 

PACKAGES 

– for cancellation up to 41 days before the start of the trip 5% of the package price

– for cancellation 40-31 days before the start of the trip 20% of the package price

– for cancellation 30-21 days before the start of the trip 30% of the package price

– for cancellation 20-11 days before the start of the trip 60% of the package price

– for a cancellation of 10 days or less to the day of departure 100% of the package price 

If the traveler cancels the arrangement, the above-mentioned term scale of the cancellation fee applies. Refunds to the user of the arrangement shall be made solely with the return of the original receipts/invoices of payment to the Agency and the signing of the receipt of the refund. 

The Agency is obliged to offer every traveler the possibility of contracting a travel insurance policy (accident insurance and illness on travel, baggage damage and loss, voluntary health insurance during time and residence abroad, travel cancellation insurance, and insurance to cover the costs of assistance and returning the traveler to the starting point in the event of an accident and illness), and provide the traveler with information on the content of such insurance as well as the general terms and conditions of the insurance contract. This insurance cannot be paid at a later date than when contracting the trip.  

When canceling the arrangement, the Agency has no obligation to refund the costs of the application for a visa, and in case the traveler has paid for travel insurance. The Agency commits to provide the traveler with all the documentation necessary to obtain the claims of the traveler to the Insurance Agency, which relates to the agreed package. The Agency recommends that the traveler be given full knowledge of the terms of the travel insurance policy. 

OTHER RIGHTS AND OBLIGATIONS OF THE AGENCY AND THE TRAVELLER 

Obligations of the Agency

The Agency is obliged to take care of the quality of service provided in the field of tourism as well as the choice of service providers with the attention of a good businessman/organizer and to take care of the rights and interests of travelers in accordance with applicable legal regulations and these General Terms and Conditions.  

The Agency is obliged to issue appropriate travel documents to the traveler and aid in accordance with these General Terms and Conditions.   

Obligations of the traveler

The traveler shall be obliged to: 

  • have valid travel documents (personal documents) and submit them to the Agency when booking a trip. The costs of losing or theft of personal documents are borne by the traveler,  

  • observe the general information on the health formalities of the country of destination or the country in transit which the Agency has notified about. The Agency will not incur any damage to the traveler’s violation of the healthcare formalities,  

  • respect the customs and foreign currency regulations of the Republic of Croatia, as well as the destination country or country through which it is in transit, 

  • adhere to the house rules in all visited facilities and cooperate with service providers in good faith, 

  • refrain from behavior that could jeopardize the safety and conduct of transport, interfere with or disturb other travelers or be the cause of their objection, 

  • inform the Agency of all objective and subjective circumstances that may significantly affect the uninterrupted realization of the travel service, comply with the instructions and cooperate with the Travel Manager and/or Agency representative,                                                       

  • upon the start of the trip show the travel manager or the representative of the Agency a document about the paid package (original voucher, etc.), this item applies only to organized group travel. 

Non-compliance of documents and/or misrepresentation of personal travel documents leading to the cancellation of the trip or the inability to continue it shall not be binding on the travel organizer and the cancellation of the cost. 

In the event of non-compliance with any of these obligations, the traveler shall answer to the Agency for any damages incurred if the Agency is liable to it.  

Travel Documents

If a visa is needed for entry into a particular country or country in transit, the Agency will inform the traveler of the need for visa clearance. The traveler shall collect and submit the necessary documentation for the visa to the competent embassy. The Agency shall, if necessary, issue a certificate of the reservation made by the traveler to the other documentation. The Agency does not guarantee the acquisition and validity of the visa. 

Travel Insurance

By signing the package travel contract, the traveler confirms that he will have travel insurance by the time of arrival to Greece.

RIGHT OF APPEAL OF THE TRAVELLER

The traveler/user of the service may file an objection or consumer complaint regarding the services provided directly to the Agency, by E-Mail and the Agency shall without delay acknowledge the reception of the objection or complaint.

The traveler/user of the service shall cooperate with the Agency in good faith in order to remove the causes of the objection or complaint and provide all the relevant documentation necessary to resolve them.

The Agency is obliged to provide written service to the beneficiary within 15 days of receipt of the objection or complaint.

APPLICATION OF JURISDICTION, JURISDICTION OF THE COURT, AND SUPERVISION OF THE AGENCY

The positive regulations of GREECE shall govern the resolution of all disputes arising under these General Terms, and for the resolution of such disputes, the competent court of Athens shall be competent. 

In all disputes between the traveler as a consumer on one side and the Agency or other service provider on the other, a traveler may file a motion to initiate a dispute settlement procedure.

Revision Fees

On or Before the Final Payment Date:

All revisions to a reservation will incur a minimum EURO 30 per person fee. These fees are non-refundable.

After the Final Payment Date:

Any change to a participant’s name, trip date, or itinerary after the final payment date is treated as a full cancellation and new reservation. All cancellation fees apply in these instances. All other revisions apply the same revision fee as above.

Not Included in Pricing

Unless specifically noted in your trip itinerary, the following is not included in your reservation.

  • airfare to and from the start of your trip;

  • costs related to passports; visas; vaccinations;

  • accommodation upgrades;

  • private car rental charges;

  • car child seats;

  • gratuities to your Tour Leader, driver, and Local Guides; 

  • hotel laundry; telephone calls; minibar;

  • alcohol, beverages, and food outside of the contracted menu as presented at a hotel or restaurant (these extra items will be billed to you before leaving the hotel, or restaurant);

  • Travel Protection (Insurance);

  • any personal or incidental items, or any other features not listed except where otherwise noted. Rates for packages including a rental car do not include state/local taxes, gasoline, optional insurance, Collision Damage Waiver (CDW), under-age driver charges if under a certain age, or airport charges, which are payable directly to the rental car company. Minimum age requirements may apply- contact us or your local travel agent for specific information. A valid driver’s license and a major credit card in the driver’s name are required.

Restrictions & Minimum Age

The minimum age to participate in any travel service offered by the Agency is 5 years of age unless otherwise specified in the itinerary information. An adult must accompany participants under 18 years of age (“minors”) on all services, including the sharing of accommodations. You are responsible for the behavior, security, and supervision of all minors on your reservation.

Reductions

Price reductions may be available to minors. Reductions only apply when sharing accommodations with two adults using existing beds. Additional beds, if available, are at the discretion of the hotel with costs billed directly to you at checkout. You are solely responsible for these costs.

Participant Cancellations

You may cancel your reservation by notifying The Agency. Calculation of cancellation amounts includes all services and fees on the invoice based on the number of days prior to departure by which we receive the notification. See the information above.

Cancellations by The Agency

The Agency reserves the right to cancel or reschedule any trip departure for any reason, including insufficient demand, strikes, lockouts, riots, stoppage of labor, or Force Majeure Event (see under “Force Majeure”).

In the event of a cancellation by The Agency prior to departure for reasons excluding Force Majeure (see section “Force Majeure”), The Agency will try, at your discretion, to rebook the same trip with a different departure date, or a similar trip, but there is no guarantee of availability. The Agency will refund the difference in price if the alternative is lower. You are responsible for additional costs if the alternative is higher. If this rebooking option is not acceptable to you, The Agency’s only responsibility is to refund the amounts paid by you for the reservation.

In the event of a cancellation by The Agency prior to departure or during your trip for conditions under Force Majeure (see section “Force Majeure”), The Agency will provide a future travel/booking credit for the portion of your trip impacted. Future travel/booking credit will be redeemable for travel with The Agency for one year past your original trip start date. If a future travel/booking credit is not acceptable to you, in the majority of Force Majeure situations, you can notify the Agency within 21 days of advisement and The Agency’s only responsibility is to refund the amounts paid by you for the portion of your trip impacted. If you do not notify the Agency within 21 days of advisement, a refund is no longer available.

The Agency is not liable or responsible for any arrangements made independently of The Agency. The Agency assumes no responsibility for costs or fees you incur for independent arrangements not booked through The Agency, inclusive of, but not limited to, airline, hotel, excursion, and travel protection-related charges.

Refunds

Any request for refunds is subject to the following terms.

Private Touring

Changes made en route at your discretion to tour features, timings, or tour services (e.g. meals, included sightseeing, etc…) are not refundable nor exchangeable for other services.

Unused Services

No refunds will be issued for unused services (late arrivals, temporary absences from your trip, or early departures), for unused transportation where group activity tickets are involved, or for voluntary modifications made by you.

Force Majeure

In the event of a Force Majeure Event (as defined below), The Agency shall be excused, discharged, and released from performance to the extent such performance is so limited or prevented, without liability of any kind.

The Agency assumes no liability for any loss, damage, or entry of any nature in whole or in part resulting from an “Act of God” or any other condition outside The Agency’s control (“Force Majeure Event”), including without limitation:

  • Fire

  • Landslides

  • Volcanic eruption

  • Inclement Weather

  • Environmental pollution or contamination

  • Earthquake

  • Low or high water levels

  • Flood

  • Water or power shortages or failures

  • Tropical storms or hurricanes

  • Riots or civil commissions or disturbances or any other acts of similar nature

  • Sabotage

  • Strikes of labor disruptions

  • Arrests

  • Restraint of rulers or peoples

  • Expropriations

  • Acts of terrorism

  • War

  • Insurrection

  • Quarantine restrictions

  • Government health advisories or warnings or alerts of any kind of nature, including, but not limited to, warnings or regulations due to an epidemic/pandemic

  • Government seizures

  • Refusal or cancellation or suspension or delay of any government authority or any license, permit, or authorization

  • Damages to its facilities or the travel supplier and its facilities

  • Or any other unforeseen circumstances or any other factors unforeseen by The Agency that adversely affect or hamper its ability to fulfill any of its contractual conditions.

Special Needs & Participation Requirements

Any special requirements or disabilities must be disclosed to The Agency at the time of reservation, or if such requirements arise after the reservation, as soon as such requirements are or reasonably should be known by the participant. If The Agency has not received disclosure of requirements or disabilities that require reasonable accommodations for accessibility, and/or if your participation poses a threat to the safety or health of self or others, The Agency may be unable to accommodate you for part or all of the Tour, Cruise or any services provided in connection with the Tour.

Suitability & Accessibility

Certain activities or venues may be limited or inaccessible to you if your mobility is limited in any manner. Many excursions and sightseeing involve extended periods of walking and standing often on uneven pavement or surfaces and may include staircases, paths, walkways, or locations that are narrow or inaccessible or of limited accessibility by wheelchair.

You are responsible for assessing if the itinerary is suitable for all participants on the reservation. We recommend you contact The Agency prior to making a reservation to determine what reasonable assistance might be available.

The Agency will make reasonable efforts to accommodate special needs but cannot guarantee that it can accommodate in all cases.

No refunds are provided for missed services or activities due to your inability to fully participate with the group, including keeping pace with the group, if conditions requiring assistance are not known to The Agency at the time of reservation or when reasonably known by the participant.

Personal Services

The Agency does not provide personal services or individual assistants to trip participants. Our staff is not required or trained to assist with personal tasks. This includes eating, dressing, toileting, lifting or pushing a wheelchair, walking, getting on or off transportation, or other personal needs. If you need such assistance, we strongly recommend you have a physically-able companion accompany you.

Wheelchairs

You must notify The Agency at the time of reservation if you are traveling with a wheelchair, or if the need for a wheelchair arises after the reservation, then as soon as that need is known.

Authority to Remove or Refuse Participants

At the sole discretion of The Agency, The Agency may refuse transport to you or may require you to leave the tour if it is reasonably believed that you

  • are dangerous to others or to yourself;

  • have engaged in, are engaged in, or are threatening to engage in behavior that may adversely affect the safety, security, comfort, enjoyment, or well-being of other participants, suppliers (including Service Providers), The Agency representatives, or crew members, including, but not limited to, behavior that is disruptive, verbally abusive, physically abusive, obnoxious, harassing, discriminatory, or obscene;

  • have failed or refused to follow, or are failing or refusing to follow The Agency’s rules and procedures or the instructions of The Agency or its representatives.

In the event you are removed, you may be left at any city, port, or airport the motorcoach stops at without any liability to The Agency or its representatives. The Agency shall not be required to refund any portion of the fare paid by you if you are removed pursuant to this section.

In the event you are removed, The Agency will not be responsible for expenses for lodging, medical care, meals, transportation, or any other expenses incurred by you. We shall be entitled to recover from you any costs or expenses incurred by The Agency, its representatives, or the crewmembers in your removal or the exercise or enforcement of this clause.

Information Required For Reservation & Travel

As a condition of reservation, you must provide the information requested by The Agency along with your initial payment. The Agency reserves the right to cancel your reservation and all services and retain all related cancellation fees if your information is incomplete or inaccurate. Your personal data is used to process your services with our Service Providers. This may include requirements to pass details to Service Providers as well as to the Greek Government or certain Greek Government-appointed bodies, or agencies in the interest of security or because we are obliged to by law.

By making a reservation with The Agency:

  • you consent to The Agency storing, using, and transferring this data to other third parties (including third parties outside your home country) for the purposes stated above

  • you indemnify and hold harmless The Agency and its affiliates in respect of The Agency for storing, using, and transferring this data as described above.

  • If any additional information is required, it will be requested from you with your reservation.

On Trip Experience

Languages used:

All Tour Leaders and Local Guides speak English, and all trip commentary and instruction are conducted in English only. For safety, maximum enjoyment, and understanding, you must be able to read, understand, and speak English.

Itinerary Timings

Itinerary timings are not guaranteed and are subject to change. No refunds are provided for changes to itinerary timings.

Optional Excursions

Optional excursions are not included in your reservation. Optional excursions are provided by independent third-party operators (“Excursion Operators”). Your contract for any optional excursion is between you and the Excursion Operators. The Excursion Operators may render services subject to separate and additional terms and conditions or may require you to execute additional documents, waivers, or releases. It is agreed and understood by you that any assumptions of liability, waivers, or releases that are part of the Excursion Operators’ terms & conditions, and any terms that are required by such Excursion Operators will also inure to the benefit of The Agency.

Optional excursions purchased through The Agency are subject to separate terms and conditions which are available during booking.

For operational reasons, not all optional excursions listed in the itinerary, in print, online, or in Travel Documents may be available during your trip. Your Tour Leader will advise of availability as applicable.

Photographs & Pictures

Photographs or pictures appearing in the brochure or on the website are solely intended as examples of facilities and attractions. Actual facilities and attractions may vary according to the itinerary. Maps shown are current at the time of publication and may not reflect the actual routing should the itinerary change.

Possession of Drugs

Any carriage or possession of illegal drugs will result in the immediate termination of your trip.

You are responsible for knowing and observing the licensing laws for drug possession (including prescription and over-the-counter drugs) in Greece. Greek laws may require you to carry a prescription from your doctor.

Punctuality on Trip

The Agency is not responsible for any losses, including missed sightseeing, meals, inclusions, optional excursions, or having to make alternate transportation or lodging arrangements, if you fail to meet the representatives at assigned timings and places/pick-up points while on the trip. The Agency will not refund nor cover any cost or expenses incurred, or compensate for any missed inclusions or optional excursions claimed, due to your inability to maintain punctuality.

Smoking

Smoking is not allowed on transportation that is exclusively provided by The Agency. Smoking includes cigarettes, e-cigarettes, cigars, e-cigars, or any other smoking or vaping device. You are responsible to abide by and adhere to Service Provider’s terms & conditions, including as they relate to smoking. This includes but is not limited to, smoking only in designated sections of vessels, hotels, or restaurants.

Smoking and Hotel Rooms

The Agency contracts non-smoking rooms. Hotels may impose a 100% non-smoking policy. If you require a smoking room, a request may be submitted, but The Agency cannot guarantee availability.

Wi-Fi on Transportation Provided by The Agency

Wi-Fi, when provided by The Agency, is supplied by an independent third party with separate Terms & Conditions, Privacy Policies, and Data Usage agreements.

The Agency is not liable for the speed, reliability, or security of Wi-Fi provided through The Agency. Connectivity is not guaranteed.

Safety & Medical Care

Certain risks and dangers may arise beyond our control, including but not limited to:

  • the hazards of traveling in undeveloped areas;

  • travel by boat, automobile, or other means of transportation;

  • forces of nature;

  • political unrest;

  • acts of lawlessness or terrorism;

  • accident or illness in remote regions without means of rapid evacuation or availability of medical facilities.

The Agency will have no liability to you regarding the provision of medical care or the adequacy of any care that may be rendered. While The Agency will use its best efforts to ensure that adequate measures are taken, by agreeing to participate in a trip and/or optional excursions, you agree that you will indemnify and hold harmless The Agency regarding the provision of medical care or the adequacy of any care rendered.

The Agency is not responsible for such risks and dangers that may arise beyond its control. Payment of your trip indicates you accept these risks and dangers and agree to hold The Agency harmless for them.

Government Travel Sites

It is your responsibility to review the current information on travel and security when making plans to travel with The Agency. You are responsible for evaluating the travel information and your acceptance of the risk of travel prior to making a reservation. By making a reservation with The Agency, you acknowledge you are aware of the travel information advised by the government of your citizenship.

Illness

The Agency reserves the right to remove or quarantine you if you show signs of illness, or pose a threat to the safety and health of other participants. Removal or quarantine for any health, safety or behavior-related assessment is at the sole discretion of The Agency. Any costs incurred for medical assessments, diagnosis, and/or any other medically-related charges are your responsibility to pay and are due at the time of services.

You will be allowed to rejoin the trip with confirmed medical certification from a licensed health practitioner indicating fitness to travel without causing harm or posing a safety or health risk to other guests.

Medical Personnel

No medical personnel travels with your group. The Agency cannot guarantee the availability of medical facilities or the quality of the care or services. Any medical attention you require while traveling with The Agency must be sought through a local medical facility, if/when available, for diagnosis. All related charges are at your expense.

Motorcoach Safety

You are responsible for wearing your seatbelt when provided. The Agency and its Service Providers are not liable for any injury, loss, damages, fines, claims, or death resulting from any accident or incident if you were not wearing your seatbelt at the time of the accident or incident when the motorcoach was equipped with them.

You are responsible for following the safety instructions provided to you. You are responsible for regulations for safety when accompanying minors. The Agency does not provide child safety devices.

Weapons

Weapons are not permitted. This includes firearms, knives, mace, brass knuckles, and weapons of any other type.

Hotel Changes

Hotels are not guaranteed. The Agency reserves the right to substitute hotels of similar standards at our discretion. No refunds are provided for hotel changes. Should you wish to cancel your reservation because of a hotel change, full cancellation fees apply.

Hotel Reward Points

Hotel rewards/points cannot be earned or redeemed with hotels used by The Agency.

Room Configuration

The Agency contracts standard, twin-bedded rooms (two separate beds per room). Double-bedded rooms (one bed per room) are not guaranteed but may be indicated as a preference during the reservation. Assignment of rooms is at the hotel’s discretion and not controlled by The Agency.

Singles

Single supplements ensure your own room but not the number of beds in a room. Single rooms are generally smaller in size and may be less conveniently located.

Triple Rooms

Availability of triple rooms at hotels varies by itinerary. 

Triple rooms accommodate three people but do not guarantee three separate beds. An additional bed, if available, is at the hotel’s discretion and may be a roll-away bed put in for the night or a convertible sofa. If existing beds accommodate three people, and you request something additional, payment of the additional bed is payable by you directly to the hotel at checkout.

Transfers

Transfers are provided by independent third-party transportation companies. Airport pickup/drop-off transfers are often group transfers operated by motorcoach and may have pre-set departure times.

The Agency is not responsible for flight delays, delays in immigration or customs, delays due to lost baggage, or for any reason beyond our control if you miss your airport transfer. Missed pickup/drop-off transfers are non-refundable. 

Baggage Disclaimer

Although every effort is made to handle passengers’ luggage as carefully as possible, the Agency is not responsible for and does not assume liability or accept claims for loss of or damage to luggage due to breakage, theft, or wear and tear through the hotel and group carrier handling. It is recommended for your own self-interest and protection that you have adequate insurance to cover these eventualities.
There are limitations by coaches as to the number and size of bags that can be carried on board and in bulk storage. Be sure to ask us or your travel advisor about such restrictions before departing for your tour.

Trip Documents

It is your responsibility to obtain and have in your possession the proper and valid documentation required for entry and departure for each country you travel to. You are solely responsible for the cost incurred during travel for missing, incomplete, or defective documentation. The Agency is not liable for any loss or expense incurred due to loss, damage, or errant entry, exit, or travel documentation.

Documents for Minors

Due to heightened security, many countries have adopted practices to prevent international abductions of children. It is your responsibility to know, understand and ensure you have the proper documentation for traveling with minors.

Guest Communications

The Agency will send invoices, hotel lists, travel advice, and other information to the email address provided when making the reservation. A full travel packet is available electronically latest 2 weeks prior to departure.

Passports

You must have a passport to travel internationally. Passports must be valid for at least six (6) months beyond the conclusion of your trip. The Agency requires your passport details prior to final documentation for all international travel.

Vaccinations or Medical Certificates

You are responsible for verifying medical requirements for your travel. This includes, but is not limited to, vaccinations, medical certificates, and insurance policies.

Visas

It is your responsibility to obtain and verify the validity of visas, and if visas are necessary for your trip. Securing and paying for all visas, entry documents, and any other requirements for entry into a country is your responsibility. It is your responsibility to carry these documents with you. The Agency is not liable for denial of entry or exit, or costs incurred for not having correct and complete documentation.

Health & Safety

The signing of a Health & Safety Waiver is required for travel with The Agency. You will not be allowed on the trip without signing the waiver and you will be subject to our cancellation fees. 

Claims or Complaints

Any complaint or claim involving your trip or the services offered by The Agency or involving the negligence of any suppliers (including Service Providers), sub-contractors, or agents in relation to any service provided to you must be made to the Tour Leader immediately while on the trip.

Written notification to The Agency may be submitted to our email address and must be received within 90 days of the trip completion, except where such limitations are prohibited by law. It is your responsibility to ensure via a follow-up or a phone call that your email has been received by us.

Agency Representation

No person, other than an authorized representative of The Agency by a document in writing, is authorized to vary, add, or waive any Term or Condition on its brochure or website, including any term or condition set forth in the preceding provisions.

A provision of these Terms may not be waived or varied except in writing, signed by the party or parties to be bound.

International Conventions & Treaties

The international carriage of passengers is subject to international conventions and treaties, where applicable. These international agreements limit and, in some events, exclude the carrier’s liability to passengers (trip participants). To the extent permitted by any relevant local law, where any claim or part of a claim (including those involving death or personal injury) concerns or involves any travel arrangements (including the process of getting on or off the transport concerned) provided by any air, sea, inland waterways, rail or road carrier, or any stay in a hotel, The Agency’s maximum liability is the maximum that would be payable by the carrier or the hotel keeper concerned under the applicable international convention, treaty, or regulation applicable to the travel arrangements or hotel stay (e.g., the Warsaw Convention, the Montréal Convention for international travel by air, the EU Regulation on Air Carrier Liability for air carriers with an operating license granted by an EU country, the Athens Convention for international travel by sea) in that situation.

DISCLAIMER OF LIABILITY

As of the date of this publication, all information is thought to be accurate, available, and current. The information, products, and services published herein may include inaccuracies or typographical errors. The Agency does not guarantee the accuracy of and disclaims liability for, any inaccuracies, including (but not limited to) the price, information, and description of the products and services described herein. The services provided herein are furnished by independent contractors who are not employees of, or joint ventures with, the Agency. The agency is not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any supplier or any personal injuries, death, property damage, or other damages or expenses resulting from causes outside of the Agency’s control. The Agency shall not be responsible for travel delays or cancellations or for any illness, death, injury, damage, or loss of vacation time arising therefrom. The Agency shall not be liable for any injuries, damages, or losses caused to any traveler in connection with or by supplier employees or contractors, terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climatic conditions, criminal acts or abnormal conditions or developments, or any other actions, omissions, or conditions outside the control of the Agency. By participating in any Tours, such participant confirms that they, and any minor children for whom they are responsible, are physically and mentally capable of such participation and that they have no medical or health conditions that would make such participation inappropriate. Such participants ASSUME FULL RESPONSIBILITY for all damage, loss, or injury to themselves and any such minor child and also ASSUME THE RISKS of all personal injury, accident, or illness to themselves and any such minor child. Under no circumstances, including but not limited to the negligence of others, shall the Agency be liable for any injury or damage to such participants or minor children. Traveler assumes complete and full responsibility for checking and verifying any and all passport, visa, inoculations, or other entry requirements of each destination, as well as re-entry into the country of origin, and all safety or security conditions at such destinations, in connection with the proposed travel.

Right to Accept or Reject

The Agency reserves the right to accept or reject any person as a trip participant; to expel any participant from the trip; to make changes in the itinerary whenever The Agency deems it necessary for the comfort, convenience, or safety of the participants; and to cancel a trip at any time.

You acknowledge and agree that our Service Providers may reserve similar rights regarding their services. You agree to abide by such conditions and further agree to indemnify and hold us harmless against any exercise of such rights by any Service Provider.

Service Providers

Accommodations and other suppliers (including but not limited to suppliers of ferries, motorcoaches, sailing boats, hotels, and excursions) providing services (Service Providers) are independent third-party contractors and are not agents, employees, servants, or joint venturers of The Agency or its affiliates. The Agency is not responsible for any negligent or willful act, omission, or failure to act on the part of any such entity or its employees, or of any other third party beyond its direct control.

From time to time, and for the purpose of identifying those Service Providers as the provider of a component or part of a package or tour, some or all of those entities may utilize the name/logo of the Agency (i.e. “TRAVEL AND DO”) on promotional media, signage, or attire. Although you may see The Agency name/logo on vehicles, signs, apparel, or elsewhere during your tour, or excursion, its use by Service Providers is solely for the purpose of identification and does not represent or signify in any way ownership, management, supervision, direction, or control, or the right to direct or control by The Agency of services that are provided by the Service Providers, or of the employees, servants, or agents of the Service Providers.

All certificates and other Trip Documents for services issued by The Agency are subject to the Terms & Conditions specified by any of our Service Providers, which are available upon request, and to the laws of Greece.

Service Responsibilities

After departure, if the Services included in the trip cannot be supplied or there are changes in an itinerary for reasons beyond the control of The Agency, depending on the circumstances, The Agency will take reasonable action to arrange for the provision of comparable services. Any resulting additional expense will be the responsibility of the trip participants and any resulting savings will be refunded by The Agency to trip participants.

Disputes

Any action arising out of or related to these Terms and Conditions or the travel reserved or undertaken hereunder shall be brought only in the courts of Athens Greece. All trip participants agree that Athens Greece shall be the sole and exclusive venue for any such action and hereby consent to the jurisdiction of the Athens Greece courts for such action.

Any claim against The Agency must be brought within 3 months after the date of the completion of the trip and not later. The parties hereby agree and specify that claims may be brought only in the public courts of Athens Greece, and the parties specifically consent to jurisdiction and venue in Athens Greece. Neither the parties nor any affiliate of the Agency shall, in any case, be liable for damages other than compensatory damages, and the parties hereby waive any right to claim punitive or exemplary damages. The parties further agree that claims may be brought by parties only in their individual capacities and not as plaintiffs or class members in any class action, proposed or purported class action, or other representative action, regardless of the type of proceeding. The parties expressly agree to waive and forego any and all rights to bring any such class actions, purported or proposed class actions, or representative actions.

Site Copyright

The copyright on all original/custom artwork, maps, navigation elements, presentation methods, and design elements included in our websites is held exclusively by the Agency. Copyright on all descriptive text is held by the Agency. Copyright on selected photographic images is also held by the Agency.

Photographic images are reproduced with the permission of the Agency and the product and/or service providers represented on the website, or as shown where necessary to satisfy the copyright obligations associated with their electronic reproduction.

Where joint copyright is held over proprietary text or images, the Agency reserves the right to pursue all copyright infringements on behalf of the primary copyright holder. Where the copyright for a photographic image is held exclusively by a third party under license, the Agency reserves the right to vigorously protect the copyright of those images on behalf of the third party.

All HTML files used in our website are declared to be proprietary software products developed for use by the Agency only, and as such are subject to international intellectual property conventions.

All custom graphics used are declared to be works of art created for use by the Agency only, and as such are subject to international intellectual property conventions. Image files, HTML documents, and text files are not to be relocated to another server or duplicated for commercial purposes without the express written permission of the Agency.

Governing Law & Dispute Resolution

This Contract shall be governed by the laws of GREECE. Should a dispute or controversy arise concerning the terms and conditions of this Contract or involving a claim for loss, injury, or other damage arising out of or relating to your trip, any legal action against the Agency shall be brought exclusively in the Courts of Athens Greece. If any term or provision of this Contract is determined by a court of competent jurisdiction to be invalid or otherwise unenforceable, such holding will not affect the validity or enforceability of the remaining terms and provisions. We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action.

Greek law governs this contract and all proceedings arising out of or related to this agreement.

FOR ALL CASES WHICH ARE NOT DEFINED IN THESE GENERAL CONDITIONS, THE PROVISIONS OF THE ACT ON THE PROVISION OF SERVICES TO TOURISM, THE LAW ON COMPULSORY RELATIONS, AND OTHER VALUE LEGAL PROVISIONS SHALL APPLY.
